Mediation and uncontested divorce can be part of the same route in South Africa. Mediation helps spouses work towards agreement. When spouses agree on the material terms, they can ask the court to finalise an uncontested divorce. The mediator does not grant the divorce; a court order is still required.

You may both want to end the marriage and still disagree about the house, maintenance or a parenting arrangement. That does not mean every issue needs to become a court battle. The useful question is: what, exactly, is preventing agreement?
How mediation and uncontested divorce fit together
Mediation is a process for resolving disagreements with the help of an impartial third party. The mediator facilitates discussion and helps you explore workable options. The decision whether to accept a proposed settlement remains yours.
“Uncontested” describes a divorce in which the spouses no longer dispute the material terms. The spouses may reach those terms directly, through attorneys or through mediation. A matter can therefore begin with disagreement and later proceed on an agreed basis.
A spouse failing to respond to divorce papers is a different situation. A default divorce has its own procedural requirements; silence is not the same as a negotiated settlement.
For the wider legal process, see our guide to divorce in South Africa. Here, the focus is on moving from unresolved issues to an informed, properly recorded settlement.
One issue left? Define the problem before negotiating
Consider a hypothetical example. A couple agrees on most divorce terms, but one spouse wants to keep the home while the other wants it sold. Repeating those positions may lead nowhere.
A more useful discussion asks what each person needs, what the property is worth and whether a buyout is affordable. It also considers the bond, transfer costs, timing and a fallback if the proposed arrangement cannot happen.
“I will take over the bond” needs practical checking. Confirm the lender’s requirements before committing to a transfer or release from liability. The settlement should deal with what happens if the lender declines finance.
This is where preparation matters. Mediation has a better foundation when the people negotiating have reliable information and understand the consequences of their choices.
Preparing for mediation and uncontested divorce
Start with a written list of agreed points, disputed points and missing information. Then work through the issues that apply to your marriage:
- Financial disclosure: income, assets, liabilities and supporting records. An agreement based on incomplete information may leave important risks unresolved.
- Property and debt: ownership, valuations, payments, transfer steps and any approvals needed from lenders or other third parties.
- Maintenance: the basis, amount, duration and practical payment arrangements for any agreed support.
- Retirement interests: whether a claim arises, which fund is involved and what wording the proposed order requires.
- Children: care, contact, maintenance and other parental responsibilities, with the child’s interests at the centre.
- Implementation: who must do what, by when, and how delays or non-compliance will be addressed.
You do not need to turn every concern into a legal argument. However, each material promise needs enough detail for both spouses to understand and carry it out. An attorney can identify gaps before they become the next dispute.
Do you need a mediator, a divorce attorney, or both?
The roles serve different purposes. A mediator helps the parties negotiate impartially. Your divorce attorney advises you on your position, explains risks and checks whether proposed terms protect your interests within the law.
Ask who is acting for whom, which work the professional will do and how they will handle conflicts. Your spouse’s attorney does not provide you with independent advice. Obtaining your own advice before signing can help you understand what you are accepting.
SD Law’s divorce mediation services explain the process and how to enquire about assistance. The appropriate professional role and scope should be clear from the outset.
From mediation to an uncontested divorce order
Reaching agreement is an important step, but it does not itself end the marriage. An attorney can help you record the settlement properly and take the divorce through the court with jurisdiction.
Section 7(1) of the Divorce Act allows a court granting a divorce to make an order about asset division or spousal maintenance in accordance with the parties’ written agreement. The court still has legal requirements to satisfy; signing does not guarantee approval.
Section 6 also protects minor and dependent children. The court must be satisfied with the arrangements made or contemplated for their welfare. If the Family Advocate conducts an enquiry under the applicable law, the court must consider the report and recommendations.
The Office of the Family Advocate assists with child-related disputes and parenting arrangements. Its role is distinct from deciding the adults’ entire financial settlement.
Ask your attorney which documents, service steps, mediation requirements or court directives apply to your matter. For preparation, SD Law’s uncontested divorce guide explains the main issues to organise.
When mediation needs a different approach
Tell your attorney or prospective mediator about threats, coercion, abuse, financial control or an inability to negotiate freely. Safety and informed participation need assessment before a joint process begins. The mediator may consider separate sessions or safeguards; mediation may be unsuitable.
Also seek advice promptly if you have received court papers or need urgent protection, financial support or arrangements for children. Negotiations should not cause you to miss a deadline or postpone necessary relief. No one should sign simply to bring pressure to an end.
Costs of mediation and uncontested divorce
Resolving disputes can reduce the work involved in contested proceedings. However, savings depend on preparation, disclosure, the issues and whether you reach agreement. Mediation fees, legal advice, drafting, service and court work may be separate costs.
Request a written scope and fee explanation. Neither mediation nor an uncontested label guarantees a fixed price or completion date.
Your next step: identify what still needs agreement
Bring your proposed terms, the key supporting documents and a short list of unresolved issues to your first consultation. Explain any deadline or safety concern. This helps the attorney assess whether the next useful step is advice, focused negotiation, mediation or a court application.
